The law of the Federal Republic of Germany applies exclusively. UN sales law does not apply to sales via mopart-shop.com.
Conclusion of contract
The product presentations on mopart-shop.com do not represent a legally binding offer, but an invitation to order.
A binding order is placed when the customer selects a product and then confirms the purchase by clicking the “Buy Now” button. The contract of sale is concluded when your order is accepted by us through a corresponding confirmation by e-mail.
Right of withdrawal
If you as a consumer place an order (natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions. If you make use of your right of revocation, you must pay the regular costs of the return shipment.

You have the right to revoke this contract within fourteen days without giving reasons.
The revocation period is fourteen days from the day on which you or a third party designated by you, other than the carrier, took possession of the goods.
In order to exercise your right of withdrawal, you must inform us [Frank Hartung, Krehlastr. 39, 31137 Hildesheim, info {at} mopart-shop.com] by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to withdraw from this contract. You may use the attached sample revocation form for this purpose, but this is not mandatory. You can also fill out and submit the sample revocation form or another clear declaration electronically on our website (insert Internet address). If you make use of this option, we will immediately (e.g. by e-mail) send you a confirmation of receipt of such a revocation.
In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the end of the revocation period.
Consequences of the revocation
If you revoke this Agreement, we shall reimburse you for all payments we have received from you, including delivery charges (other than any additional charges arising from your choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date on which we receive notice of your revocation of this Agreement. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to make any refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us or to (insert here, if applicable, the name and address of the person authorised by you to take delivery of the goods) immediately and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. The time limit shall be deemed to have been observed if you dispatch the goods before the expiry of the period of fourteen days.
You shall bear the direct costs of returning the goods.
You will only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary for checking their nature, properties and functioning.

Prices and shipping costs
All prices stated on mopart-shop.com include the legal value added tax and other price components. For shipping within Germany we charge no fees. For shipping within Europe, we charge a flat-rate shipping fee which can be found on the order site. For all other international deliveries, we charge a flat-rate shipping fee depending on the delivery country. The shipping costs incurred can be found on the respective product pages and in the order overview.
Delivery
Delivery shall be made by a forwarding agent to be named by us. The regular delivery time within Germany is 3 days. If the delivery times deviate from this, we point this out on the corresponding product pages.
Payment
The payment can be made either by SEPA-transfer or by PayPal. If you choose the payment method prepayment, we will send you our bank details in the order confirmation. In this case a delivery will only take place after receipt of payment.
Retention of title
The goods remain our property until full payment has been received.
Settlement of disputes
The EU Commission has created an Internet platform for the online settlement of disputes. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
